By using InstantHire, you agree to these terms. Please read them carefully.
Agreement
These Terms of Service ("Terms") are a binding agreement between you and InstantHire ("we," "us," or "our"). By accessing or using our website and services (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service
InstantHire aggregates and displays hiring posts and related information for the creator economy. We provide search, sorting, alerts, and links to original postings. We do not guarantee that every listing is current, accurate, paid, or still available. You are responsible for evaluating opportunities and any agreements you enter with employers or clients.
Accounts
Some features require an account. Sign-in is offered through Google via our authentication provider. You must provide accurate information and keep your account secure. You are responsible for activity under your account. Notify us promptly if you suspect unauthorized access.
We may suspend or terminate accounts that violate these Terms, pose a security risk, or are used for abuse or unlawful activity.
Email alerts and communications
If you subscribe to job alerts or other emails, you consent to receive messages at the address you provide. You can unsubscribe at any time using the link in our emails or our unsubscribe page. Message frequency may vary. Standard message and data rates may apply.
Acceptable use
You agree not to:
- Use the Service in violation of applicable law or third-party rights;
- Scrape, crawl, or harvest data from the Service except as allowed by robots.txt or our written permission;
- Attempt to gain unauthorized access to systems, accounts, or data;
- Interfere with or disrupt the Service (including via malware, excessive automated requests, or denial-of-service);
- Misrepresent your identity or affiliation;
- Use the Service to send spam or misleading communications.
Third-party content and links
Job listings and external links are provided for convenience. We do not control third-party sites, employers, or applicants. Your dealings with third parties are solely between you and them. We are not a party to hiring contracts and are not responsible for wages, scope, safety, or outcomes of any engagement.
Intellectual property
The Service, including its design, branding, software, and curated presentation, is owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal or internal business purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by law or with our written consent.
Third-party trademarks and content remain the property of their respective owners.
Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTANTHIRE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.
Indemnity
You agree to defend, indemnify, and hold harmless InstantHire from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
Changes
We may modify the Service or these Terms at any time. We will post updated Terms on this page and update the effective date. Material changes may also be communicated by email or notice on the site. Continued use after changes constitutes acceptance.
Termination
You may stop using the Service at any time. We may suspend or terminate access for any reason, including violation of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, and indemnity) will survive termination.
Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles, except where mandatory local law requires otherwise. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there, unless applicable law requires a different forum.
General
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement regarding the Service and supersede prior agreements on the same subject.
